ELK TOWNSHIP BOARD OF SUPERVISORS MEETING MINUTES September 10, 2007 The Elk Township Board of Supervisors meeting convened at 7:00 PM at the Elk Township Building, Lewisville, PA. The following Supervisors were present: Chairman, Palmer Durborow; Vice Chairman, Estace Walters; and Member, Albert Jezyk, Jr. PUBLIC COMMENTNo public comment. ADMINISTRATIVE ACTION/PRESENTATIONS/CORRESPONDENCEErinc Conditional Use DecisionPal
Durborow stated that the Erinc Conditional Use Appeal was granted by the
Commonwealth Court of Pennsylvania with the option of further review of the
conditions. Pal explained that the
Township was not able to reach an agreement with the appellant in regards to
the conditions. Therefore, the Board has agreed that the conditions as
originally upheld by the Court are final.
On
a motion made by Estace Walters, seconded by Al Jezyk, the Board approved the
Erinc Conditional Use Plan dated June 24, 2002, subject to the satisfaction
of the conditions as described in Exhibit A.
The vote was unanimous.
Woolsten Final Subdivision PlanOn
a motion made by Estace Walters, seconded by Al Jezyk, the Board accepted the
Lake Roeder Hillard and Associates extension letter dated August 27, 2007 for
the Woolsten Final Subdivision Plan.
The vote was unanimous.
Springlawn Road Trail Improvement Change Order #1 Pal Durborow referred to Springlawn Road Trail Improvement Change Order #1 (Bid Item #17 Bridge #4) that results in a decrease of $11,992.00 to the total bid amount. The work completion date has been adjusted to September 21, 2007. Census 2010Pal Durborow referred to United States Department of Commerce correspondence dated August 2007 inviting the Township to participate in the 2010 Decennial Census Local Update of Census Addresses (LUCA) Program. The program will allow the Township to review and update the Census Bureau’s address list and maps. Open Space Recreation & Environmental Resource PlanPal Durborow referred to Township Engineer Stan Corbett’s correspondence dated August 23, 2007 regarding the Township’s Open Space, Recreation, & Environmental Resources Plan of 1995. Pal explained that although the plan does not satisfy all the requirements of Act 153 for revenue expenditures, compliance is possible with an ordinance amendment. Chester County Planning Commission Intergovernmental Cooperative Planning Agreement The Board agreed to forward the revised Intergovernmental Cooperative Planning Agreement to the Township Solicitor for review. Notice of Richard Ruggerio Variance HearingPal Durborow referred to the Notice of Hearing for the Richard Ruggerio Variance Application scheduled for September 19, 2007 at 7:00 PM. Chrome Barrens Hunting PermitsThe Board agreed to issue fifty-on (51) hunting permits for the 2007/2008 hunting season. 2008 BudgetThe Board agreed to schedule the 2008 Budget Work Meeting for Monday, October 15, 2007 at 6:00 PM. STAFF REPORTSSecretary’s Report On a motion made by Estace Walters, seconded by Albert Jezyk, the August 6, 2007 Public Hearing Minutes and the August 6, 2007 Board of Supervisors Meeting Minutes were approved. The vote was unanimous. Treasurer’s Report On a motion made by Al Jezyk, seconded by Estace Walters, the Bills to be Paid for September, with the exception of Roadmaster Payroll, were approved. The vote was unanimous. On a motion made by Al Jezyk, seconded by Pal Durborow, the Bill to be Paid for Roadmaster Payroll was approved. Estace Walters abstained from the vote. Durborow referred to the August Planning Commission Meeting Minutes.
Zoning Hearing BoardThe Variance Hearing for the Richard Ruggerio Application is scheduled for September 19, 2007 at 7:00 PM. Zoning Officer Pal Durborow referred to the August Zoning Officer Report stating that two (2) Building Permits, three (3) Use & Occupancy Permits, and one (1) Enforcement Notice were issued. On-going projects include The Bluffs at Big Elk Creek, various single homes and various inquiries regarding codes, zoning, etc. Roadmaster Estace Walters referred to the September Roadmaster Report. Estace stated that the Board has received a request for speed humps from residents of Media Road. The Board agreed to forward the request to the Pennsylvania Department of Transportation (PennDOT). Estace stated that PennDOT has changed its regulations to require that all street signs contain six (6) inch lettering by a certain date.
Post Office Committee
The Board agreed not to pave the Post Office parking lot this year. Historical Commission Pal Durborow stated that Susan Dougherty has expressed interest in serving on a Township committee. Pal suggested that Susan serve on the Historic Commission.
Open Space CommitteeThe Board agreed to advise the Township Solicitor to proceed with the Open Space Earned Income Ordinance. OLD BUSINESSNo

NEW BUSINESSSenior Citizens Expo
The 13th Annual Southern
Chester County Senior Citizens Expo is scheduled for Friday, September 28,
2007 at the Union Fire Company Hall.
Fireproof Filing CabinetThe Board agreed to research the possibility of purchasing additional fireproof file cabinets for the Township office. PUBLIC COMMENT
John Dennison stated that certain areas of the Springlawn Trail are very steep and asked if the Township has control over the hunters in the Chrome Barrens. Pal stated that issues regarding the Springlawn Road Trail will be addressed prior to it being opened to the public; and that hunters in the Chrome Barrens must abide by state hunting regulations.
