ELK TOWNSHIP BOARD OF SUPERVISORS

MEETING MINUTES

November 5, 2007

 

The Elk Township Board of Supervisors meeting convened at 7:00 PM at the Elk Township Building, Lewisville, PA.  The following Supervisors were present:  Chairman, Palmer Durborow and Vice Chairman, Estace Walters.  Member, Albert Jezyk, Jr. was not present. 

 

PUBLIC COMMENT

No public comment.

 

ADMINISTRATIVE ACTION/PRESENTATIONS/CORRESPONDENCE

Union Fire Company

On a motion made by Pal Durborow, seconded by Estace Walters, the Board agreed to purchase lockboxes for use by the Union Fire Company.  The vote was unanimous among Supervisors present.

 

Ordinance No. 2007-06 An Ordinance Establishing the Adoption of the Oxford Regional Government Planning Agreement

On a motion made by Pal Durborow, seconded by Estace Walters, Ordinance No. 2007-06 An Ordinance Establishing the Adoption of the Oxford Regional Government Planning Agreement was enacted. The vote was unanimous among Supervisors present.

 

Agreement for Vacation of Township Road T-354 Springlawn Road

On a motion made by Pal Durborow, seconded by Estace Walters, the Board approved of the Agreement for Vacation of Township Road T-354 Springlawn Road.  The vote was unanimous among Supervisors present.

 

Grant of Public Trail Easement (Springlawn Road)

On a motion made by Pal Durborow, seconded by Estace Walters, the Board approved of the Grant of Public Trail Easement for Springlawn Road.  The vote was unanimous among Supervisors present.

 

Etha McDowell – Oxford Area Recreational Authority

Etha McDowell provided an update on the Oxford Area Recreational Authority and requested that the Board consider enacting a recreation fee to be imposed on developers.  Pal Durborow stated that the Board would consult with the Township Solicitor.   

 

Agricultural Area Security Application – Reuben Beiler

Pal Durborow stated that an Agricultural Area Security Application has been received  for property owned by Reuben Beiler.

 

2008 Budget

Pal Durborow stated that the 2008 Proposed Budget is available for public inspection.

 

SPCA 2008 Contract

Pal Durborow stated that the annual cost for the SPCA 2008 Full Contract is $2,198.00  The Board would like to verify that the cost has been calculated properly prior to signing the contract.

 

Conservation Easement Program – Fisher Property

Pal Durborow referred to Brandywine Conservancy correspondence dated November 2, 2007 stating that they are applying for a Preservation Partnership Grant for the farm owned by Stephen and Lydia Fisher.  No Township funds will be required for this conservation easement.

 

Lewisville Post Office

Pal Durborow stated that the Board is hosting a retirement party at the Township Building for Phyllis and Millie on November 30th. 

 

On a motion made by Pal Durborow, seconded by Estace Walters, the Board agreed to commit $100.00 towards a retirement party for Phyllis and Millie.  The vote was unanimous among Supervisors present.

 

Tax Claim Bureau

On a motion made by Estace Walters, seconded by Pal Durborow, the Board authorized the Chester County Tax Claim Bureau to remove tax liens in the amount of $19.44 for property owned by Gary Price.  The vote was unanimous among Supervisors present.

 

STAFF REPORTS

Secretary’s Report

On a motion made by Estace Walters, seconded by Pal Durborow, the October 1, 2007 Board of Supervisors Meeting Minutes were approved.  The vote was unanimous among Supervisors present.

 

Treasurer’s Report

On a motion made by Estace Walters, seconded by Pal Durborow, the Bills to be Paid for October, with the exception of Roadmaster Payroll, were approved.  The vote was unanimous among Supervisors present.

 

Tax Collector

$201.12 in real estate taxes was collected.

 

Planning Commission

Pal Durborow referred to the October Planning Commission Meeting Minutes stating that there was no new business.

 

Zoning Officer

Pal Durborow referred to the October Zoning Officer Report stating that three (3) Building Permits and one (1) Use and Occupancy Permit were issued.  On-going projects include The Bluffs at Big Elk Creek, various single homes and various inquiries regarding codes, zoning, etc. 

 

Roadmaster

Estace Walters referred to the October Roadmaster Report stating that repairs to Blake Road are complete and that the Hickory Hill Road pipe project will begin this week.

 

Post Office Committee

No report.

 

Historic Committee

Mary Gruber gave a presentation regarding the 150th anniversary of Elk Township.

 

Open Space Committee

The Open Space Earned Income Tax Ordinance Public Hearing will be advertised for December.

 

OLD BUSINESS

No old business.

 

NEW BUSINESS

Pal Durborow stated that the Township Solicitor advises that the Board consider an amendment limiting the duration of approval for a Conditional Use, Special Exception or Variance.

 

PUBLIC COMMENT

A Township resident had a question regarding the Earned Income Tax and was referred to Jim Hunt of Berkheimer Associates.

 

Mark Gruber asked if Township Engineer Stan Corbett would attend the next Planning Commission meeting.  Pal Durborow stated that the Township Secretary would confirm with Stan.
