ELK TOWNSHIP BOARD OF SUPERVISORS MEETING MINUTES July 3, 2006 The Elk Township Board of Supervisors meeting convened at 7:00 PM at the Elk Township Building, Lewisville, PA. The following Supervisors were present: Chairman Palmer Durborow, Vice Chairman Estace Walters and Member Albert Jezyk. PUBLIC COMMENT ON AGENDA ITEMSNo public comment. ADMINISTRATIVE ACTION/PRESENTATIONS/CORRESPONDENCEOrdinance No. 2006-03 Open Space Land Acquisition Tax ReferendumPal Durborow stated that the enactment of Ordinance No. 2006-03 would allow an Open Space Land Acquisition Tax Referendum to be included on the November ballot. Pal gave an overview of the Open Space Committee’s efforts to date and explained the benefits of protecting open space in Elk Township. On a motion made by Estace Walters, seconded by Albert Jezyk, the Board enacted Ordinance No. 2006-03 Open Space Land Acquisition Tax Referendum. There was no public comment. The vote was unanimous.
FEMA/PEMA DamageAssessmentPal Durborow referred to the Chester County Department of Emergency Services correspondence dated July 1, 2006 regarding storm damage assessment. Emergency Operations Coordinator Alan Kennedy has confirmed that there were no reports of damage in Elk Township. Wilson King Plot PlanPal Durborow stated that a revised Wilson King Plot Plan has been submitted to the Township. Chester County Septage Management SystemChester County Health Department has scheduled an informational Septage Management session on July 27th. Township

STAFF REPORTSSecretary’s Report On a motion made by Estace Walters, seconded by Albert Jezyk, the June 5, 2006 Meeting Minutes were approved. Treasurer’s Report On a motion made by Estace Walters, seconded by Albert Jezyk, the Bills to be Paid for July were approved. The vote was unanimous. Pal Durborow referred to the June Planning Commission Meeting Minutes. Zoning Hearing BoardNo activity. Zoning Officer Pal Durborow referred to the June Zoning Officer Report stating that two (2) Building Permits and one Certificate of Occupancy were issued On-going projects include The Bluffs at Big Elk Creek, various single homes and various inquiries regarding codes, zoning, etc. RoadmasterPotholes were patched and road projects were worked on. POST OFFICE COMMITTEE REPORT OLD BUSINESS Legal Issues Regarding Agricultural OrdinancesPal Durborow referred to a newsletter article stating that some townships are being sued for enacting agricultural ordinances with regulations that are over and above what the state allows. Open Space FinancingPal Durborow stated that Tara Tracy of the Brandywine Conservancy has provided information regarding alternate programs available for properties that do not quality for county programs. Armstrong CablePal Durborow referred to Armstrong Cable correspondence dated June 22, 2006 requesting that the Township express opposition to Senate Bill #1247 (The Cable Choice and Competition Bill) to the State Senator and Representatives. Pal stated that the Board is still waiting for Armstrong Cable to sign the Cable Agreement with the Township. NEW BUSINESSNo new business. PUBLIC COMMENT
