ELK TOWNSHIP BOARD OF SUPERVISORS MEETING MINUTES February 5, 2007 The Elk Township Board of Supervisors meeting convened at 7:00 PM at the Elk Township Building, Lewisville, PA. The following Supervisors were present: Chairman Palmer Durborow, Vice Chairman Estace Walters and Member Albert Jezyk. PUBLIC COMMENTNo public comment. ADMINISTRATIVE ACTION/PRESENTATIONS/CORRESPONDENCEAvery BuildersBud Avery presented a sketch plan and requested that the Board provide comment regarding sewage capacity for the Village District and road access. Pal Durborow stated that the Board could not provide comment at this time and would follow-up with the Township Solicitor. Long View Farms Sewage Operation and Maintenance AgreementPal Durborow stated that the Long View Farms Sewage Operation and Maintenance Agreement has been reviewed and approved by the Township Solicitor and Township Engineer. On a motion made by Estace Walters, seconded by Albert Jezyk, the Board approved the Long View Farms Sewage Operation and Maintenance Agreement. The vote was unanimous. Resolution 2007-03 Long View Farms Sewage Facilities Planning Module Submittal to Pennsylvania Department of Environmental ProtectionPal Durborow gave an overview of the issues regarding the Long View Farms Sewage Facilities Planning Module and stated that Planning Commission and the Public Comments have been addressed. On a motion made by Estace Walters, seconded by Albert Jezyk, Resolution 2007-03 Long View Farms Sewage Facilities Planning Module Submittal to Pennsylvania Department of Environmental Protection was adopted. The vote was unanimous. Long View Farms Preliminary Subdivision PlanPal Durborow stated that the outstanding issues regarding the Long View Farms Preliminary Subdivision Plan have been addressed with the exception of a few issues that will be addressed on the Final Plan. On a motion made by Estace Walters, seconded by Albert Jezyk, the Board approved the Long View Farms Preliminary Subdivision Plan dated October 29, 2004 Latest Revision December 6, 2006. The vote was unanimous. Fair Hill Estates Preliminary Subdivision PlanOn a motion made by Estace Walters, seconded by Albert Jezyk, the Board accepted the Government Specialists, Inc. extension letter dated February 1, 2007 for the Fair Hill Estates Preliminary Subdivision Plan. The vote was unanimous. Springlawn Road Trail Grant Contract Addendum Number 3 On a motion made by Estace Walters, seconded by Albert Jezyk, the Board approved the Springlawn Road Trail Grant Contract Addendum Number 3. The vote was unanimous. FEMA National Flood Insurance ProgramPal Durborow referred to FEMA correspondence dated January 10, 2007 stating that Elk Township has been reinstated into the National Flood Insurance Program. Subdivision & Land Development Ordinance and Official MapPal Durborow referred to Chester County Planning Commission correspondence dated January 26, 2007 providing a review of the proposed Subdivision & Land Development Ordinance and Official Map. Department of Community & Economic Development Grant ContractPal Durborow referred to Department of Community & Economic Development correspondence dated January 2007 awarding a $10,000.00 grant for improvements to the Township Building. The grant funds will be used for a new heating and air conditioning system for the Township Building. On a motion made by Estace Walters, seconded by Albert Jezyk, the Board approved of the Department of Community & Economic Development Contract for Community Revitalization Assistance Program. The vote was unanimous. Union Fire Company No. 1 Volunteer Firefighters’ Relief Association Audit ReportPal Durborow referred to Department of the Auditor General correspondence dated January 31, 2007 providing a copy of the Audit Report for the Union Fire Company No. 1 Volunteer Firefighters’ Relief Association. Township RoadmasterThe Board agreed that Estace Walters will continue to serve as Township Roadmaster. STAFF REPORTSSecretary’s Report On a motion made by Estace Walters, seconded by Albert Jezyk, the January 2, 2007 Board of Supervisors Meeting Minutes were approved. The vote was unanimous. Treasurer’s Report On a motion made by Al Jezyk, seconded by Estace Walters, the Bills to be Paid for January, with the exception of Roadmaster Payroll, were approved. The vote was unanimous. On a motion made by Al Jezyk, seconded by Pal Durborow, the Bill to be Paid for Roadmaster Payroll was approved. Estace Walters abstained from the vote. Pal Durborow referred to the January Planning Commission Meeting Minutes. Zoning Hearing BoardNo activity. Zoning Officer Pal Durborow referred to the January Zoning Officer Report stating that two (2) Building Permits were issued. On-going projects include The Bluffs at Big Elk Creek, various single homes and various inquiries regarding codes, zoning, etc. Roadmaster Pal Durborow referred to the January Roadmaster Report.

OLD BUSINESSPublic Water Overlay Zoning DistrictPal Durborow referred to URS Corporation correspondence dated January 2, 2007 summarizing the issues discussed with the Planning Commission regarding the Public Water Overlay Zoning District. The Board agreed to address this issue once the Subdivision & Land Development Ordinance and Official Map are adopted. The Bluffs At Big Elk Creek Pal Durborow stated that the Board has not yet received feedback regarding the drainage issue at The Bluffs At Big Elk Creek. 273 Camp Bonsall Road Pal Durborow stated that the Zoning Officer is continuing to research ownership of the 273 Camp Bonsall Road property. NEW BUSINESSExecutive SessionPal Durborow stated that an Executive Session was held with the Township Solicitor to discuss various legal issues. PUBLIC COMMENT
John Groce asked if there is a timeframe for adopting the Public Water Overlay District Ordinance. Pal Durborow stated that the first step is for the Planning Commission to provide recommendations as to where public water should or should not be allowed. Pal explained that the Public Water Overlay District Ordinance must correspond with the Zoning Ordinance and that the Planning Commission should work with the Township Engineer to ensure that the ordinances do not conflict. Linda Luker asked if the Township has adopted the Property Maintenance Code. Pal Durborow referred Linda to Zoning Officer George Guss for further information regarding the Property Maintenance Code adopted by the Township. Meeting Adjourned at 7:45 PM.
