ELK TOWNSHIP BOARD OF SUPERVISORS

MEETING MINUTES

February 2, 2004

 

The Elk Township Board of Supervisors meeting convened at 7:00 PM at the Elk Township Building, Lewisville, PA.  The following Supervisors were present:  Chairman Daniel Williams, Vice Chairman Palmer Durborow and Member Estace Walters.

 

PUBLIC COMMENT ON AGENDA ITEMS

No public comment.

 

ADMINISTRATIVE ACTION/PRESENTATIONS/CORRESPONDENCE

 

Resolution 2004-03 Elk Township Fee Schedule

On a motion made by Pal Durborow, seconded by Estace Walters, Resolution 2004-03 Elk Township Fee Schedule was adopted.  The vote was unanimous.

 

April Pierson – Oxford Mainstreet Inc.

April Pierson of Oxford Mainstreet Inc. presented to the Board an overview of the plans for the revitalization of the Oxford downtown area.  The plans include working to preserve esthetics and architecture, marketing, recruiting and promoting businesses and looking for local funding. 

 

Proposed Amendment to Zoning Ordinance July 2002 Sections 200, 801 and 802

Dan Williams stated that the Proposed Amendment to the Zoning Ordinance Sections 200, 801 and 802 need to be forwarded to the Chester County Planning Commission for review prior to scheduling a hearing.

 

On a motion made by Pal Durborow, seconded by Estace Walters, the Board agreed to forward the Proposed Amendment to the Zoning Ordinance Sections 200, 801 and 802 to the Chester County Planning Commission for review.  The vote was unanimous.

 

Proposed Fire and Emergency Inspection Ordinance

Dan attended a meeting with Union Fire Company to discuss the Proposed Fire and Emergency Inspection Ordinance.  The Fire Company supports the Proposed Amendment that also will provide funding for the firehouse.  Linda Luker asked if Zoning Officer George Guss would perform the inspections.  Dan stated that George Guss would inspect at the time the Use and Occupancy Permit is issued.  Al Jesyck asked what is the fee for the inspection.  Dan stated that the fee is not set at this time.

 

On a motion made by Pal Durborow, seconded by Estace Walters, the Board agreed to forward the Proposed Fire and Emergency Inspection Ordinance to Chester County Planning Commission for review.

 

 

 

 

Proposed Development of Dempsey Property “Preliminary Opinion” Request

Attorney Saul Ewing Correspondence Dated January 16, 2004

Dan referred to Attorney Saul Ewing correspondence dated January 16, 2004 requesting a “Preliminary Opinion” of the proposed development of the Dempsey property for compliance with Village District zoning requirements.  Dan explained that the Township must follow the proper procedure in response to this request and that the Zoning Officer would render an opinion.  Mark Plaugher asked if Solicitor charges for review of this request are charged to the Township or the applicant.  Dan explained that the Township is bound by the Municipal Planning Code as to what fees can be charged to a developer and that this review would be paid by the Township.  There is currently proposed legislation that would allow Townships to charge Solicitor review fees for Subdivision and Land Development to the developer.

 

Household Hazardous Waste Collection Program

On a motion made by Pal Durborow, seconded by Estace Walters, the Board approved the Township’s participation in the SECCRA Household Hazardous Waste Collection Program.  The vote was unanimous.

 

Union Fire Company 2003 Year End Report

Dan referred to the Union Fire Company 2003 Year End Report.

 

Oxford Area Recreation Authority

On a motion made by Pal Durborow, seconded by Estace Walters, the Board agreed to pay the Oxford Area Recreation Authority annual per capita dues of $1,485.00.  The vote was unanimous.

 

Hickory Hill Road – Traffic Control

The Township has received concerns from residents regarding speeding and signage on Hickory Hill Road.  Dan stated that the Board follow-up on the signage and speed limit on Hickory Hill Road.

 

King Row Road & Route 472 Intersection

Pal stated that the Board received a request from a resident that the Township request PennDOT install a stop sign at the intersection of Route 472 and King Row Road.  Pal stated that the Board has previously discussed this intersection with PennDOT representatives.  The Board agreed to correspond in writing to PennDOT to again alert them of concerns with this intersection.  The correspondence will be copied to Senator Pileggi and Representative Hershey. 

 

Act 537 Plan

Dan stated that Elk Township has not adopted an Act 537 Plan and currently relies on the county’s plan.  An Act 537 Plan would include a concept on how Elk Township would handle various sewage issues within the township.

 

On a motion made by Dan Williams, seconded by Pal Durborow, the Board agreed to research an Elk Township Act 537 Plan. The vote was unanimous.

 

Newsletter

Dan stated that the Board would like to create another newsletter and requested that anyone interested in volunteering to contact the Secretary.

 

STAFF REPORTS

 

Secretary’s Report

On a motion made by Pal Durborow, seconded by Estace Walters, the January 5, 2004 Meeting Minutes were approved.

 

Treasurer’s Report

On a motion made by Pal Durborow, seconded by Estace Walters, the Bills to be Paid for February were approved with the exception of the Evans Mills Environmental and URS Corporation invoices.

 

Tax Collector

            Real Estate:      $106.42

 

Planning Commission

Dan referred to the January Planning Commission Meeting Minutes.

 

Zoning Hearing Board

An Application for Challenge to Validity of Zoning Ordinance Section 802A.1.a by Avery Builders Inc. has been received. 

 

On a motion made by Pal Durborow, seconded by Estace Walters, the Board agreed to forward the Application for Challenge to Validity of Zoning Ordinance Section 802A.1.a by Avery Builders Inc. to the Zoning Hearing Board and to the Zoning Hearing Board’s Solicitor.  The vote was unanimous.

 

Zoning Officer

Dan referred to the January Zoning Officer Report stating that one Building Permit and no Use & Occupancy Permits were issued.  On-going projects include Peacedale Court, The Bluffs at Big Elk Creek, Elk Heights, various single homes and various inquiries regarding codes, zoning, etc.  Code items include sending an Enforcement Notice to the State Radio Project office regarding the ninety foot monopole installed by the State on the Dougherty property; denying request for temporary Use & Occupancy Permit for The Bluffs at Big Elk Creek due to outstanding septic issue with CCHD; and investigating placement of signs on King Row Road property.

 

Roadmaster

Roadmaster Michael Arbolino reported that the drainage problems on Route 472 will need to be addressed in the spring and that a grate needs to be installed on a storm drain in Reserves of Coventry Greene.  Approximately 128 hours were spent on snow plowing and salting roads.  There were problems with the salt company not being providing salt as per their contract with PennDOT and the road crew had to travel to Camden to pick up salt from another company.

 

A resident stated that he felt that the township truck should not be parked in another township and that an Elk Township resident should perform the job.  Dan stated that Mike Arbolino has been plowing for the Township for six years and has done a good job.  Pal stated that prior to hiring Michael Arbolino, the Board requested that any interested parties contact the Board and at that time no one expressed interest. 

 

OLD BUSINESS

Dougherty Property – Installation of Pole

This issue was covered in the Zoning Officer Report for January.

 

NEW BUSINESS

No new business.

 

PUBLIC COMMENT

Linda Luker stated that there were not enough copies of the Meeting Minutes, Agendas, and etc. for the meeting.  Secretary to provide additional copies for future meetings.

 

Florence Henderson stated that there have been two break-ins in Elk Township in the last week.

 

Delbert Steele requested that the Board use a speaker system during the meetings so that all residents can hear what is being said.

 

A resident expressed concern regarding the dumping of trash on Hickory Hill Road.

 

Lin Klein expressed concern regarding the speed of truck traffic at the Elk Creek Ranch entrance.  George Guss to follow-up with property owner.

 

Al Jesyck expressed concern regarding the level of noise form the fans at Elk Creek Ranch.  George Guss to follow-up with property owner.
